The Extradition procedure offers the possibility of transferring individuals from one State to another to be sanctioned or to comply with a sentence period or precautionary measure already established. The truth is that this procedure offers a great possibility as far as the criminal process is concerned, since without the possibility of extraditing people between governments such as the Republic of Italy and the Republic of Chile, there would not be an opportunity to prosecute fugitives from justice who are refugees in other countries, avoiding being tried, but it would also be impossible, to transfer a subject who has committed a crime in a certain country and wishes to be tried or comply with their sanction in the territory of the State of which it is a national.

The Extradition Treaty between the Governments of the Republic of Italy and the Republic of Chile.
On May 3, 2017, the Extradition Treaty between the Republic of Chile and the Italian Republic and its Additional Protocol is promulgated in Santiago, which, on February 27, 2002, was signed in Rome; and that, between the same Parties, the Additional Protocol to said Treaty was signed on October 4, 2012, in Santiago.
This Treaty regulates the conditions for the extradition to proceed, and also establishes the terms and manner of proceeding upon acceptance or denial of the extradition request. It also establishes the way in which the transfer of the individual object of the request will take place and of course the rights attributed to it.
It also regulates the crimes for which it will be possible to access the extradition request, as well as those that represent an impediment to carry out the process. Similarly, it specifies the treatment granted to nationals and the guarantees that the requesting country has in these cases, in which it denies its request. The Treaty regulates other important elements such as the person's time of detention, the modalities and the language of the communications, as well as the documents that support the request. It also regulates the decision and delivery of the person and the objects.
The simplified extradition.
The Treaty regulates that the requested Party may deliver to the claimed person, without giving effect to the extradition trial provided for in its domestic legislation, provided that the following requirements are met:
- that an extradition request has been submitted in accordance with Article X;
- that the fact by which extradition is requested meets the conditions set forth in article II; Y
- that the claimed person, assisted by an authorized lawyer, gives his express consent to be extradited.
The consent, which will be irrevocable, will be given before the competent Authority of the requested Party, after it has informed the claimed person of the following:
- the irrevocable nature of your consent;
- your right to a formal extradition procedure and the respective guarantees; Y
- the simplified extradition procedure ..
